  • Buyer's License Agreement

    All of our Author's Artworks (photos, vector images, software templates, etc.) are covered by our Buyer's License Agreement. If your Final Product includes the Author's Artworks which are going to be free to the end user or sold no more than once then a Standard License is what you need. If your Final Product is an e-learning course then a Standard License is also applied. An Extended License is required if the Final Product is going to be sold more than once, is preparing to be used as a part of an "Out-of-Home" advertising campaign or as a part of product labeling and packaging.

    Standard License

    The essential aspects of this agreement

    1. The Standard License grants you an ongoing, non-exclusive, worldwide license to make use of the Author's Artworks you have chosen. Read the text of this license for the details which apply to your use of the Author's Artworks.
    2. You are licensed to use Author's Artworks to create one single Final Product for yourself or for one client.The Final Product can be distributed for Free or be sold no more than once.

    An Exception: You can sold the Final Product unlimited number of times in case your Final Product is a web-based (non CD) e-learning course.

    Things you can do with the Author's Artworks

    1. You can create one Final Product for a client, and you can transfer that single Final Product to your client for any fee no more than once. This license is then transferred to your client.
    2. You can make any number of copies of the single Final Product, as long as the Final Product is distributed for Free.
    3. You can change, modify or manipulate Author's Artworks. You can combine Author's Artworks with other files and make a derivative work from it. The results are subject to the terms of this license. You can do such things as long as the Final Product you're creating is one that's meet the definition of the Final Product.

    For example: You can license the Simple Course Template, include your own images, change the background, text layout, etc. and present it to the audience.

    Things you cannot do with the Author's Artworks

    1. You can’t sell the Final Product more than once (excepting cases when your final product is an e-learning course). If you or your client want to sell the Final Product, you will need the Extended License.
    2. You can't use Author's Artworks to create logos and trademarks.
    3. You can’t re-distribute Author's Artworks in stocks. You can’t do this with Author's Artworks either on its own or bundled with other files, and even if you modify Author's Artworks. You can’t re-distribute or make available Author's Artworks as-is or with superficial modifications. These things are not allowed even if the re-distribution is for Free.

      For example: You can’t license Author's Artworks and then make it available as-is on your website for your users to download

    4. You can’t use Author's Artworks in any application allowing an end user to customize a digital or physical product to their specific needs, such as an “on demand”, “made to order” or “build it yourself” application. You can use Author's Artworks in this way only if you purchase a separate license for each Final Product incorporating Author's Artworks that was created using the application.

    Examples of “on demand”, “made to order” or “build it yourself” applications: website builders, “create your own” slide-show apps, and e-card generators. You will need one license for each product created by a customer, or contact us to discuss.

    Other License Terms

    1. You can only use the Author's Artworks for lawful purposes. Also, if the Author's Artworks contains an image of a person, even if the Author's Artworks is model-released you can’t use it in a way that creates a fake identity, implies personal endorsement of a product by the person, or in a way that is defamatory, obscene or demeaning, or in connection with sensitive subjects.
    2. This license can be terminated if you breach it. If that happens, you must stop making copies of or distributing the Final Product until you remove the Author's Artworks from it.
    3. The author of the Author's Artworks retains ownership of the Author's Artworks but grants you the license on these terms. This license is between the author of the Author's Artworks and you. Elearningchips is not a party to this license or the one giving you the license.

    Extended License

  • Refund Policy for Buyers

    eLearningchips is responsible for Final Products you purchase. These rules are based on consumer laws that we consider are the best “baseline” to apply to transactions that happen on eLearningchips. Please be aware that in addition to these rules, each country has its own laws surrounding refunds, and these local laws are not excluded if they apply to you.

    The situations in which eLearningchips gives a refund on a Final Product Buyer has purchased are the following:

    1. Final Product is "not as described"

    A Final Product is "not as described" if it is materially different from the Final Product description or preview. eLearningchips is required to provide Buyer with the requested Final Product which matches the declared description within 72 hours from the day Buyer e-mailed us at support@elearningchips.com. If it turns out that eLearningchips did not provide Buyer with the requested Final Product in an appropriate timeframe, then Buyer is entitled to a refund of that Final Product.

    2. Final Product does not work the way it should

    If a Final Product doesn't work the way it should and can't easily be fixed Buyer is entitled to a refund of the Final Product. If the Final Product can be fixed, then the eLearningchips is required to do so within 72 hours from the day that you discovered the problem by updating the Final Product, otherwise Buyer is entitled to a refund of that Final Product.

    3. Final Product has a security vulnerability

    If a Final Product contains a security vulnerability and can't easily be fixed Buyer is entitled to a refund of the Final Product. If the Final Product can be fixed, then the eLearningchips should do so within 72 hours from the day that you discovered the problem by updating the Final Product. If the Final Product contains a security vulnerability that is not patched in an appropriate timeframe, then Buyer is entitled to a refund of that Final Product.

    Why a refund may not be given

    If the Final Product is materially similar to the description and preview and works the way it should, there is generally no obligation to provide a refund.

    How and when will I be refunded?

    Refund requests are accepted within 30 days from the day you made a purchase. If Your refund request is accepted, You will receive the corresponding funds directly into Your PayPal account within 72 hours from the day that you e-mailed us at support@elearningchips.com. All refunds will be made in US dollars.

    Returning an item

    Please, be aware: given the nature of downloadable digital items, we do not offer a return of the Final Products.

  • Contributors' Commission Fee

    All contributors who sell their artworks via eLearningchips are provided with the personal account, where they monitor the whole sales statistics. The revenue is distributed equally between both parties, the stock and the contributor (50/50). Once the amount of sales reaches $50, the contributor can withdraw money via PayPal.

  • Registration and Submission of Artworks

    I want to become a Contributor and upload my artworks. What should I do?

    1. Sign up for eLearningchips
    2. Choose "Yes" in "Do You Want To Become a Contributor" field
    3. Enter your personal information and "Collection URL" field which will simultaneously be a link to your collection of artworks
    4. Send the examples of your artworks with the source files to: contributors@elearningchips.com
    5. Upload your artworks to eLearningchips FTP server after confirmation of co-operation

    The access to FTP server will be available after moderator's approval of your works.

    Please, note:

    1. All artworks are moderated. Only high-quality works which meet Artwork Requirements will be taken 
    2. All artworks are available to customers under the terms of Buyer's License Agreement
    3. Uploading your artworks you accept the terms of Contributor's Public Agreement
    4. Your artworks will be available to customers after moderator's approval

    Watch the growth of commissions in your personal account and make withdrawal to "Pay Pal". Withdrawal will be available upon reaching the $50 balance.

  • Privacy Policy

    eLearningchips.com (hereinafter – Website) Privacy Policy for users specify how eLearningchips uses the personal data obtained or collected from customers (hereinafter - the "Users") of this Website.

    1. Users

    Warning! Persons under 18 years old are prohibited to create User's account at elearningchips.com.

    This Website is intended for adult Users only. If User's age is under 18 years, the User or visitor should ask the parents or guardians to obtain a permit for the registration and use of eLearningchips Website.

    2. Collected and processed data

    2.1. When you visit the Website we have the right to collect and process:

    • Non-personal data such as: IP-address (Internet protocol address), type of browser and operating system;
    • Personal data, such as name and last name, e-mail address, postal address, credit card data, your billing information. If you are the author (Contributor) of a File, in the registration form or while entering into the Agreement, we have the right to ask for an identification document, issued by the government of the country in which you reside. We may also collect Contributor’s data for tax charges;
    • User’s data, such as number of page views and downloads, behavior on the Website, personal profile edits, left comments, and other activities on the eLearningchips Website.

    2.2. eLearningchips can collect and use personal data for the following purposes:

    • Identity verification in order to ensure the safety of the Website, entering into a Contributor’s Public Agreement and / or Buyer’s License Agreement;
    • Creating User’s account and ensuring its stable operation;
    • Processing your comments and suggestions;
    • Providing relevant information on the offers that may interest the User;
    • Processing your online purchases;
    • Continuous monitoring of Users’ and visitors’ activity;
    • Informing Users and visitors about new services.

    If you choose not to provide us with your personal data, we may not be able to provide the above services.

    We store personal data for as long as it is necessary to fulfil the purposes for which we collect the data.

    3. Cookies

    3.1. Cookies are used to manage normal functioning of the Website. Cookies are files that are stored with Website server on the User's computer and contain data that can be used by the same server to provide the correct functioning of eLearningchips services. The cookies store data about the session ID, cart details, data to calculate banners display statistics and other service information.

    3.2. We do not enable third parties to place cookies on your device.

    3.3. You can disable cookies in your browser setting (for example under the “Preferences” or “Internet Options” features of your browser). Note, however, that some features of the Website may not function properly if you disable the cookies.

    4. Protection of personal data

    4.1. By registering on the Website (by pressing the «Submit» button), Users hereby consents to the processing of their personal data by eLearningchips, and taking actions provided by EU Data Protection Directive (Directive 95/46 / EU), by the Law of Ukraine "About protection of personal data» № 2297-VI, June 1, 2010, and by Russian Federation regulation, p. 3 of Art. 3 of the Federal Law, 27.07.2006, № 152-FZ "About Personal Data", by any means, for the purposes of entering and execution of the Agreements between the User and eLearningchips.

    4.2. Providing eLearningchips with personal data is voluntary. Each User of the Website has the right to change or delete his/her personal data on the «Account» page.

    4.3. eLearningchips is obliged not to share, sell, rent, publish, distribute or otherwise use your personal data unless otherwise provided by law, this Agreement and (or) the Buyer’s License Agreement and the Contributor Public Agreement. At the request of Government authorities, or when it is reasonably necessary to protect the rights, property or safety of others, or eLearningchips.

    4.4. eLearningchips may share your personal data only with:

    4.4.1. eLearningchips employees, to which is reasonably necessary or desirable to disclose personal data to perform their duties;

    4.4.2. Financial institutions, in that amount and only in order to provide the relevant services;

    4.4.3. Government authorities and other third parties, if required by law, to fulfil obligations under law in good faith. These cases include the providing of data as a result of receiving a summons, court decisions, orders, requests, etc.

    4.5. Personal data, collected by eLearningchips, can be processed in a country different from the country of User’s residence. Filling in the application form and providing other data you agree that it can be transferred abroad.

    4.6. eLearningchips is not liable for personal data obtained by a third party, as well as for loss, alteration or misuse of such data. This also includes data submitted to a third party, as well as the failure of a third party to keep to eLearningchips Privacy Policy.

    4.7. Under current law, you have the right to access your personal data, which we process, the right to correct, delete or block such personal data and the right to prohibit certain actions on processing the data. In order to exercise the rights, you should send a written request, using our contact information info@elearningchips.com

    5. Changes

    eLearningchips hereby notifies that eLearningchips may change the Privacy Policy unilaterally. Current version of this Privacy Policy, published on the Website, shall always apply to all User's actions. The changes take effect immediately upon posting them on the Website.

  • Artworks Requirements

    Photos

    Technical requirements:

    • Image resolution that you send to us should be not less than 300 dpi (minimal size of smaller side 1200 рх).
    • The image colour model should be sRGB.
    • Digital format of the image.
    • The image must not contain noise, dust & scratches, chromatic aberrations at 100% zoom.

    Legal requirements:

    • It is you who must be the author of the work and all its components
    • Images must not contain logos or trademarks
    • If image depicts a real person you must provide Model Release
    • Images must not contain buildings, products or places protected by intellectual property right (in case if real existing objects are depicted)
    • All images must comply with eLearningchips ethical standards

    Commercial, artistic, subject requirements:

    • Images only of original size must be uploaded. You must not increase the image size using special software, for an image of small size to satisfy technical requirements; also there is no need to reduce image size, unless necessary.
    • Images must have correct exposure, subject must be in focus.
    • The image subject must correspond with subject of eLearningchips’ stock.

    Vector

    Technical requirements:

    • Vector file must be supplied in .eps or .ai format, not lower than the 5-th version of illustrator.
    • Preview images must be in PNG or JPEG format, which corresponds to vector version
    • Preview image must be not less than 595 px of smaller side (but you can also send images of large size, but not bigger than 25 Mpx)
    • Colour space must be RGB
    • File names eps, ai and jpg must coincide, for example, «my_file.jpg» and «my_file.eps»
    • Each ZIP file must not exceed 50 Mb.

    Legal requirements:

    • It is you who should be the author of the work and all its components
    • Vectors must not contain logos or trademarks
    • If vector depicts a real person you must provide Model Release
    • Vectors must not contain buildings products or places protected by intellectual property right (in case if real existing objects are depicted)
    • All works must comply with eLearningchips ethical standards

    Commercial, artistic, subject requirements:

    • Vectors only of original size must be uploaded. You must not increase the vector size using special software, for a vector of small size to satisfy technical requirements; also there is no need to reduce vector size, unless necessary.
    • Vectors should be creative and detailed (simple images with lack of creative details would be rejected by moderator of the Website).
    • Vector image must not contain copyright fonts.
    • Vector image must not be tracing or drawings with the help of special software (such routings must be done manually, it is you who must be the author of the routed material, we can ask you to provide such materials to prove that you are their author).

    eLearningchips ethical requirements

    We do not accept:

    • files depicting scenes of violence;
    • files of obscene, pornographic, offensive content;
    • files depicting photographs or video;
    • files depicting logos, trademarks, trade names;
    • files containing images of objects that are protected by patents, copyrights or intellectual property rights, contemporary art works;
    • files depicting elements of design protected with copyright;
    • files based on archival images, illustrations, magazines, reproductions, etc.;
    • files containing images of documents indicating personal data, screensavers, computer screens, up-to-date maps;
    • files illustrating elements of military awards, military property, symbols and attributes of state power, government property.
